Distribution of Free Printed Material in Newquay 

You only require a consent to distribute free printed material for the Newquay Town Centre area in Cornwall. However, Cornwall Council are currently carrying out a review of existing controls in Newquay and are also considering whether there are any hotspots elsewhere in Cornwall, which may benefit from similar provisions to control litter. The public consultation period for this review ended on 24 November 2016 and is due to be considered by the Council at its next Communities Policy Advisory Committee to be held on 31 January 2017.

Completed forms should be submitted to the Licensing Service, Cornwall Council, Chy Trevail, Beacon Technology Park, Bodmin, PL31 2FR.

Consents will last for a period of 12 months and each consent permits up to four people to distribute.

Submitting your application does not constitute implied consent. Once you have submitted your application, you should allow 14 working days for a decision to be reached before your consent is issued.

Only one consent will be issued per premises/business/licensee/applicant.

There is a comprehensive range of business regulatory support services available to help and advise businesses to be more successful and compliant.

Hours of Distribution

Distribution is permitted between the hours of 10:00 and 02:00. However, nightclubs are not permitted to distribute before 19:00 and lap dancing clubs are not permitted to distribute before 20:00. Businesses are required to patrol the designated area to pick up their litter for at least 30 minutes afterwards.

Free Printed Material

You will be required in your application to state what type of free printed material you intend to distribute. Some examples of free printed material are things such as:

  • Paper flyers
  • Wristbands
  • Cards
  • Tickets
  • Anything tangible which is printed and used for the purposes of promotion (it does not include printing on the body such as "Hand Stamps").

Exemptions

This would include Charities, Religious or Political Groups, none of whom are required to have a consent under the statute.

If you are not physically handing out free printed material and merely showing it to somebody without giving it to them, this does not require a consent. (However, there may be other offences such as obstruction or public nuisance).

Costings

The cost for a flyering consent depends on how many pieces of material you wish to hand out in any one week.

Fee for processing and issuing a consent plus ID cards - £54/annum (no Vat – outside scope).

Plus, in addition, a fee based on the number of flyers issued as follows:

All Council car parks in Newquay are prohibited.

ID Badges for Distributors

Once you have received your consent from Cornwall Council, you will be issued with ID Badges for your distributors to wear. These will be numbered with the name of the business who applied for the consent on and not the distributor's individual name. All personnel are required to wear their ID Badges at all times whilst distributing free printed material.

Maximum Number of Flyers

We do not permit more than 5000 flyers to be distributed in one week. If you wish to distribute 5000 in one week, we will allow up to 5000 in a week but not all on one day. You may distribute a maximum of 2500 in any one day.
